CENTRAL RESERVATIONS OF MAMMOTH TERMS & CONDITIONS
AGENCY DISCLOSURE Central Reservations of Mammoth (CRM) acts as the agent and representative of all vacation rental property owners on the CRM vacation rental program, and is acting at all times, in and for the best interests of the owners. As the agent for vacation rental owners on the CRM rental program, CRM represents the vacation rental property owner at all times.
MUST BE 21 YEARS OF AGE OR OLDER- to reserve, book, register and check-in to a Mammoth Lakes Vacation rental. . Someone 21 years of age or older must register, occupy and take all responsibility for the Mammoth Rental.
RESERVATION REQUIREMENTS and PAYMENT- Reservations risk cancellation prior to arrival until you have signed the Rental Agreement to confirm the details of your reservation and accept all CRM policies. 50% of the total rent is due at the time of booking. Credit Card payments are charged automatically. Guests who arrange to pay by check must make their payment within seven (7) days from when the details of your reservation are confirmed. The remaining balance is due no later than thirty (30) days prior to your check-in date. Guests paying with Credit Cards will be charged automatically for the remaining balance. Check payments must be remitted on time. Reservations placed within thirty (30) days of check-in require 100% payment in full. Credit card payments are run automatically. Check payments must be remitted within 7days or on arrival, whichever comes first. CRM accepts debit cards with the Visa or Master Card logo or Visa, Master Card or Discover Credit Card. If a check payment is dishonored by the bank for any reason guests agree to pay $50 for each dishonored check. Initial
Holiday Reservations (Dates surrounding Christmas, New Years and Presidents Week): All reservations are non-refundable at time of booking. NO REFUNDS OR REBATES will be offered unless we can rebook your reservation. Payment in full is due by check with-in 7 days of booking. CRM reserves the right to ask all guests to pay by check and not accept credit card payments. You will be contacted by an agent if you need to pay by check.
CHECK-IN TIME IS 4 PM. Some locations have combination Lock Boxes at the Property Office or Condo Itself. Some Condos have coded door locks. Lock Box Codes for unit keys or Codes for Front Door Locks are emailed to guests with their confirmation. Check-in locations are determined at the time of reservation.
Holiday Reservations (Dates surrounding Christmas, New Years and Presidents Week): Check-in is 5 PM.
CHECK-OUT TIME IS 10 AM. Timely Check out is required. Follow the instructions in the unit on where to leave the keys when you check-out. If the property keys are not returned per instructions in the unit upon check-out Central Reservations of Mammoth is authorized to charge the Guests credit card on file for cost of re-keying or replacing all of the locks and re-issuing new keys to the owner, cleaning staff and agents. Guests that do not check-out by 10 AM may be charged a fee equal to the rental rate for one day.
CHECK-OUT PROCEDURES- Guests agrees to Remove all Trash (trash dumpsters are located in the parking lots), Load and Wash All Dirty Dishes In The Dishwasher, Replace Furniture Back to Original Position in Unit If it has Been Moved, Leave All Heaters On Low Setting, Turn Off Lights, Close and Lock All Windows and Doors and Follow Key Return Instructions in the Unit.
SECURITY DEPOSIT HELD AS DAMAGE PROTECTION Our Mammoth Lakes Vacation Rentals require a security deposit be held as damage protection. A $500 Refundable Security Deposit will be held on the credit card on file prior to arrival and through departure to cover repair cost for damages. Any and All Damage accidental or intentional MUST be reported to the office before check out. In the event there is reported or unreported accidental or intentional damage, excessive cleaning, or additional charges or penalties are warranted by a breach of rental agreement you will be notified by email or by phone and said charges will be deducted automatically from the Security Deposit held on credit card. The Security Deposit Held on the card is released 14 days or sooner from the departure date minus any applicable damage repair or replacement charges. The Security Deposit Held as Damage Protection is fully refundable to the card after departure date if there is no reported or unreported damage. Guest accepts all liability for any damage and agrees the amount of the Security Deposit Held as Damage Protection does not limit the Guests liability to the amount held on credit card as a Security Deposit. In the event there are reported or unreported damage repair costs in excess of the $500 Security Deposit, Guest Authorizes the credit card provided with the guests reservation be charged for damage repair or replacement costs in excess of the $500 Security Deposit Held as Protection.
CANCELLATION POLICY Cancellation is free if cancelled within 24hrs of booking. There is a $100 cancellation fee on all reservations after 24hrs of booking. Cancellations must be submitted in writing and confirmed received by Central Reservations of Mammoth Office no later than thirty (30) days prior to the original check-in date in order to receive a refund. If cancellations, rescheduling, or changes are made less than thirty (30) days prior to the original check-in date NO REFUNDS OR REBATES will be offered, unless we can rebook your reservation. NO EXCEPTIONS. No refunds or rebates will be offered for cancelling reservations that have been rescheduled for dates after the original check-in date. Holiday Reservations (dates surrounding Christmas, New Years and Presidents Week) are non-refundable at time of booking. We highly recommend purchasing travel insurance to avoid loss due to unforeseen cancellations. Reservations made on travel sites such as Airbnb, VRBO or similar sites will be subject to cancellation policies posted on those sites.
COVID-19 CANCELLATION POLICY: Cancellations due to Covid-19 will only be made if the Mono County Health Department says that people may not travel to Mammoth Lakes. As long as lodging remains open under the guidance of Mono County Health Department not cancellations for Covid-19 will be accepted.
RESCHEDULING AND CHANGES Any rescheduling or changes within 24hrs of booking are free. Guests may reschedule or change a reservation subject to a $25 administrative processing fee for each change after 24hrs from booking. All rescheduling or changes must be done no later than (30) days prior to arrival. Rescheduling or changes made less than 30 days prior to arrival will be subject to NO REFUND OR REBATE if original reservation cannot be rebooked. We highly recommend purchasing travel insurance to avoid loss due to unforeseen changes and rescheduling.
NO SHOW/EARLY DEPARTURE POLICY Central Reservations of Mammoth is not responsible for Guests Not Arriving or Early Departure. NO REFUNDS OR REBATES will be offered for Guest Not Showing Up or Early Departure. We highly recommend purchasing travel insurance to avoid loss due to unforeseen circumstances preventing guests from arriving on time or early departure.
REFUNDS The terms and conditions of this Mammoth Lakes Vacation Rental Agreement are legally binding between Guest, CRM and Owner. Your reservation binds you to a specific period of time. Agent will make every effort to correct any problem that arises during your stay in a timely manner subject to the terms in this agreement. There will be no refunds or compensation for events out of Agents control including but not limited to: Acts of God, Mother Nature, acts of war or government agencies, road maintenance, gas shortages, power outages or water outages, construction or maintenance work in the vicinity, equipment failures, snow and road conditions, proximity to other dwellings, business closures and area event schedule changes. NO GUARANTEE OF SNOW OR WEATHER CONDITIONS, ROAD CONDITIONS, POWER, CABLE, INTERNET, OR TELEPHONE OUTAGES, POOL OR SPA BREAKDOWNS. We highly recommend purchasing travel insurance to avoid losing your vacation investment due to unforeseen circumstances that are out of Agent's control.
MAXIMUM OCCUPANCY The maximum occupancy is stated in all accommodation descriptions. These limits are required by law and are for the safety and protection of occupants and Owners. Any children are considered an occupant and are included in the occupancy total. Rollaway beds, cots, inflatable mattresses & sleeping bags or other temporary or portable sleeping device not specifically provided by the owner and intended for use to accommodate extra persons are prohibited. A WORD OF CAUTION IF YOU ARRIVE WITH OR AT ANY TIME OCCUPY A MAMMOTH LAKES VACATION RENTAL WITH MORE PEOPLE THAN YOU HAVE BEEN REGISTERED OR STATED IN MAXIMUM OCCUPANCY DESCRIPTION, ITS A CRIME. PENAL CODE NO 537 MAKES IT A CRIME TO DEFRAUD AN INNKEEPER. SHOULD THIS SITUATION ARISE, YOUR LICENSE TO OCCUPY THE UNIT WILL BE REVOKED IN THE PRESENCE OF A POLICE OFFICER AND YOU WILL BE TRESPASSING. WHEN THE POLICE OFFICER PRESENT OBSERVES THE CRIME OF TRESPASS YOU WILL NOT BE PERMITTED TO OCCUPY THE UNIT AND NO REFUND WILL BE MADE, UNLESS WE ARE ABLE TO RE-RENT THE UNIT YOU RESERVED.
LICENSEE OF OWNER - Renting the unit creates a license to occupy the Mammoth Lakes Vacation Rental Property Nightly. Renting the property in no way creates a tenancy or any form of interest in the property.
UNIT INFORMATION The Unit Information used to describe the property is deemed accurate and reliable but is not guaranteed. Rates, furnishings, fees, taxes and other unit information are subject to change without notice. Please call or email to confirm information prior to booking.
PARKING- Maximum 2 parking spaces per property. Some Properties require Parking Permits. Parking permits for your vehicle will be provided upon check-in for those Properties requiring parking permits.
MOTOR HOMES, BOATS, TRAILERS- No Motor Home, Boat or Trailer Parking or Motor Home Occupancy is allowed on Property. If you travel in a Motor Home or plan to have a Boat or Trailer, you must when making your reservation notify the Central Reservations of Mammoth Office to arrange prior to your arrival where to park your Motor Home, Boat or Trailer.
RIGHT OF ENTRY - Agents reserve the right to enter property at anytime to investigate disturbances, check occupancy, check for damages, make repairs, locate source of leaks into lower units, alterations, and improvements, as Agents deem necessary.
URGENT/EMERGENCY SERVICE CALLS In case any equipment malfunctions, guests notify Central Reservations of Mammoth immediately to arrange for repairs and initiate an urgent service call. Every effort will be made to correct any urgent situation in as little time as possible. CRM cannot guarantee against malfunctions of heating, electricity, water, any appliances, spa tubs, cable, satellite, television, telephones, electronics, internet connections, gas logs, grills, etc. No refunds or compensation will be given for failure of the above. Any service call requested by guests that is a result of guest action, abuse, misuse or negligence may result in a $40 service charge plus $40/hr of onsite labor and will be billed to guests credit card. NO refunds or rebates will be offered in conjunction with false or mistaken service calls.
NON-ESSENTIAL SERVICE CALLS Every effort will be made to provide clear concise procedures at the condo for operating equipment such as Internet and WIFI access password, satellite TVs, DVD players, fireplaces and key lock boxes as well as clear accurate directions to the unit from Hwy 395. CRM is not responsible for guests inability to operate equipment or follow the directions which may result in a service call for assistance. Any non-essential service call requested by guests to operate equipment, combination lock boxes or to take guests to property may result in a $40 service charge plus $40/hr of onsite labor and will be billed to guests credit card. NO refunds or rebates will be offered in conjunction with guests inability to operate equipment or locate the vacation rental.
LOCK OUT Guests who are locked out of a Mammoth Lakes Vacation Rental may be charged a $40 service call plus a $40/hr onsite labor fee to provide Guests access to the Mammoth Lakes Vacation Rental. If a locksmith needs to be called due to action of Guest, Guests credit card may be charged accordingly.
CABLE/SATELLITE TV - Rental properties are individually owned and CRM cannot guarantee TV channel availability. Most Vacation Rental properties do not offer premium Movie, Sports, Pay Per View Channels, etc. CRM cannot under any circumstance activate premium channels. NO EXCEPTIONS! NO REFUNDS OR REBATES will be offered.
WOOD BURNING FIREPLACES - California’s fire season runs from approximately June 1 Sept 30. Most units contain wood burning fireplaces or wood burning stoves and should only be used seasonally from October 1 through May 31.
ITEMS LEFT BEHIND - Agents are not responsible for any items Guests leave behind intentionally or unintentionally on Premises. Found Items will be returned if Guests request found item be returned to them. Agents are authorized to charge a $25 handling fee plus applicable shipping costs for the return of any items Guests leave behind.
HOT SPAS and POOL Guests may not add any objects or chemicals to the Spa or Pool on the property. If Rental Guest adds anything to a Spa or Pool that results having to clean or drain the spa or pool the Rental Guest agrees their credit card may be charged for cost of service. Guests understand that spa and pool usage is at their own risk and will not hold Agent or Property Owner responsible for any injury. It is prohibited for children to use the Spa Tub or Pool without a responsible adult. Central Reservations of Mammoth requests Guests turn off spa jets and where spa covers are provided, to cover spa when not in use. The EMERGENCY spa and pool switch must always be left on to allow continuous water circulation, heating and filtration. Please Activate emergency switch only in case of emergency.
FURNISHING/FURNITURE - All units are privately owned, furnished and equipped by its OWNER. As such, Central Reservations of Mammoth cannot make any changes to the furnishings or equipment provided by the owner. If Guest requires special appliances or equipment, please bring them with you or inquire about renting from a third party service. Furnishings are subject to change without notice. Rearranging or moving of furniture is prohibited and will result in an extra cleaning fee incurred for the extra time to arrange furniture back to original placement. Loss of these items, as well as accidental damage to the property or furnishings not covered by Security Damage Protection will be charged to Guest(s), the renter. Certain areas in each Mammoth vacation rental property are locked for the OWNERS personal storage and are not included in this rental.
LINENS - A standard supply of linens is provided in each property. Bed linen and bath towels are not exchanged daily during your stay. A startup supply of bath soap, toilet tissue and trash bags are provided. Additional supply of bath soap, toilet tissue and trash bags are available to pick up during office hours. Housekeeping service and other cleaning arrangements during your stay are available for an additional charge. Contact the Reservations Office for details.
LONG DISTANCE TELEPHONE CALLS - Some Unit telephones are toll restricted and do not permit long distance calls except for toll free numbers, calling card calls, credit card calls, collect calls, valid third party calls, and emergency (911) calls. Some units have unlimited long distance. Cell-phones are usually reliable in most Mammoth vacation rental properties but cannot be guaranteed.
WIFI AND HIGH SPEED INTERNET ACCESS- Most Units provide high speed internet access. Every effort will be made to provide the correct network key/password for accessing wireless internet in units where the owner has provided internet access. CRM does not provide technical support for high speed internet access. CRM is not responsible for guests inability to connect to the units WiFi or access or connect to the internet. No refund will be offered for poor or no WiFi connection.
NON-SMOKING NO EXCEPTIONS! This includes Marijuana, Vapping, E-cigarettes, all Tobacco Products and any other recreational smoking products. All Mammoth Lakes Rentals are non-smoking (including all decks, porches and steps). Guests agree to pay not less than $350 for odor abatement if they smoke in the vacation rental or if cigarette butts or other smoking waste is left on the grounds.
ALCOHOL/DRUGS No drinking of alcoholic beverages by persons under the legal age of twenty-one (21) is allowed on rental properties. If Guest is arrested for underage drinking at rental property or if Agent observes Guests under the legal age of twenty-one (21) drinking alcoholic beverages, Agent reserves the right to terminate this Agreement and evict Guests with no refund or rebate. Illegal drug use is strictly prohibited and prosecuted to the fullest extent of the law.
CONDUCT Occupancy and use of premises shall not be such as to disturb or offend neighbors or residents by means of including but not limited to; parties, excessive speeding through neighborhoods, riding of ATVs or Off Road Motorcycles/Dirt Bikes, excessive noise and/or obnoxious behavior, discharging of Firearms, BB/Pellet Guns, Paint Ball Guns, Potato Cannons, or Fireworks, or any other noise-inducing mechanisms. Agents reserve the right to terminate this Agreement and evict Guests with no refund or rebate.
WILDLIFE Mammoth Resort is home of many different types of wildlife including but not limited to Bear, Deer, Squirrels, Mice, Chipmunks, Yellow Jackets, Carpenter Ants, Spiders, Flies etc. Guests may encounter wildlife at any time and any where during their stay. NO REFUND OR REBATE will be offered in connection with any wildlife encounters.
PET POLICY Some vacation rental properties are pet friendly and allow for Pets. In those vacation rental properties that allow pets, the following terms and conditions apply: A $50 non-refundable pet fee is charged per stay for pets to cover normal clean-up required as a result of a pet being on the premises. NOTE: Pets are not permitted in the spa and pool area. Guests will be charged not less than a $100 cleaning fee if pets get into the spa or pool. Pets must be completely housebroken, well behaved, and free of fleas or other pests. Pets are not allowed on furniture. Guests will be charged no less than a $50 cleaning fee for removing pet hair and other pet-related material from furniture. Guests may not use any vacation rental linens or towels on pets Pets shall not be left alone on premises. Guest agrees to pay for any damages caused by pets not covered by Security Deposit Protection. If pets have an accident in cabin, all clean-up will be performed by the Guests. Guests further agree to police waste from the grounds and deposit in outside dumpsters or trash cans. Failure to comply with pet clean-up policy on the premises may result in additional cleaning charges that will be charged to the guest’s credit card. Guests agree to fully supervise and control their pets at all times and take full responsibility for their pets well being. There is a leash law that requires pets in the Town of Mammoth Lakes and Mono County be on a leash. Guests with pets should plan accordingly. If any of these Pet Policy items are not met, Guests are in violation of this Agreement. Guest authorizes CRM to charge Guests credit card on file for any damages sustained as a result of pets or for removal of pet hair and extra cleaning caused by pets.
SERVICE DOGS/EMOTIONAL SUPPORT ANIMALS Service animals are working animals trained to perform tasks for the benefit of individuals with physical or mental disabilities – such as guiding people who are blind, alerting people who are deaf, alerting and protecting people prone to seizures and other tasks directly related to a disability.
Dogs or other animals whose sole function is to provide comfort or emotional support do not qualify as service animals under the Americans with Disabilities Act. Emotional Support Dogs Allowed only in units that are designated as Pet Friendly. Guests with Service Dogs can contact our office for approval in non-pet friendly condos.
ANIMALS IN NON-PET FRIENDLY PROPERTIES: If a property does not specify it is “pet friendly” then NO ANIMALS OF ANY KIND FOR ANY REASON can be in the property. This includes but is not limited to emotional support animals, pets of any kind and ADA service animals that did not notify property management of the animal in advance. All guests found with an animal in a property that does not specifically state they are pet friendly or have not received prior approval from Central Reservations of Mammoth will be fined $500.
DAMAGES TO PROPERTY - Premises are to be left in clean, undamaged condition, and Guests must follow check-in and check-out procedures, along with the pet policy. Guests must call Central Reservations of Mammoth if any damages or defects are noticed.
REFUSAL OF SERVICE Mammoth Vacation Rental Properties are privately owned and Managed by Central Reservations of Mammoth (CRM). Management reserves the right to refuse service to anyone. All CRM vacation rental properties are rented without regard to race, color, religion, sex, national origin, or handicap.
TERMINATION BY OWNER/SUBSTITUTIONS Agents strive to comply with all reservation requests for specific vacation rental properties. However, due to ownership changes, properties being removed from rental use, mechanical problems, or other unforeseen circumstances outside of Agents control, CRM cannot absolutely guarantee a specific property. Agents reserve the right to change property unit assignment to a comparable property without liability within a reasonable time frame should rental property become unavailable. A comparable property will have similar or better value, accommodations, function, unit amenities, or size as determined by the Company. No refunds will be offered when comparable properties are available. Should Guest decline the comparable property, Guest may reschedule or change their reservation to another available date and property at the published rates under the parameters of the rescheduling policy but no refunds will be offered. If comparable properties are not available, Guests will have the option of selecting from any other available properties for their reservation dates and pay or receive a refund of the difference in the total cost or may choose to receive a full refund minus a $50 processing fee under the parameters of this agreement.
VIOLATION OF AGREEMENT - A material breach of this Agreement by Guests, which, in the sole determination of the Agents, results in damage to the Premises, personal injury to Guests or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for revoking the Guests license to occupy the property. Violation of any of the rules contained herein will result in revoking the Guests license to occupy the property and IMMEDIATE EVICTION. If Guest(s) hold over in possession after Guest(s) occupancy has expired, commit a material breach of any provision of this Agreement that according to its terms would result in the termination of Guest(s) occupancy or have obtained possession of the Premises by fraud or misrepresentation NO REFUNDS OR REBATES will be issued when the license to occupy the property is revoked, unless we are able to re-rent the property. Any reservation made under false pretenses will result in forfeiture of advance payments and the party will not be permitted to check-in. Guest agrees that by checking into the vacation rental property this Agreement shall be considered read, understood, and treated as though it were executed and agreed to in the County of Mono and Town of Mammoth Lakes.
DISPUTES Choice of Law/Venue. The terms and conditions of this rental agreement shall be construed and treated as though it were executed in the County of Mono and enforced in accordance with the laws of the State of California. In the event of any litigation, action or proceeding arising under this agreement, the Parties agree that the only convenient forum shall be in the county of the Premises that was rented by the Owner to the Renter. The interpretation of this agreement and its performance shall be governed solely by the laws of the state of California without reference to the conflicts of laws rules of California. The parties agree that the proper jurisdiction and venue for any legal action arising out of this Agreement shall be the Superior Court of California, County of Mono, Mammoth Lakes Division.
ATTORNEYS FEES. In any action or proceeding arising under this agreement, or concerning the Property or its condition, the prevailing party shall be entitled to its reasonable attorneys fees and its cost of suit as allowed by law.
INDEMNIFICATION AND HOLD HARMLESS - Guests shall be solely responsible for any property damage, accident or injury to any person or loss sustained by any person, including but not limited to loss of money, jewelry, valuables of any kind, auto, contents, theft and other items of personal property, arising out of or in any way related to Guests use of the premises or the items of personal property provided by CRM, the Owner at Guests request. Guests shall inspect and be familiar with proper use and application of such items prior to using them. Guests hereby agree to INDEMNIFY and hold Agent(s) and its employees, owners and officers; and/or Homeowners harmless from any and all claims including those of third parties, arising out of or in any way related to Guests use of premises or the items of personal property provided therein. Guests hereby agree to hold Central Reservations of Mammoth (CRM) and its employees, owners and officers and/or Homeowner, harmless and to indemnify same against any and all claims that arise pertaining to any event during the course of rental as a consequence of any acts or omissions of CRM and/or vacation rental owner, its Agents, employees and officers. Guests assume the risk of injury or other losses relating to any recreational activities and will hold owner, CRM and its Agents harmless with respect thereto.
CREDIT CARD Guest Agrees they have provided their credit card number as a guarantee. Guest agrees to pay all rent and associated fees, accept all terms and conditions of the occupancy agreement and accepts all liability for any damage not covered and/or in excess of Security Deposit Held As Damage Protection and/or beyond normal wear and tear during the term of my occupancy with CRM. If I fail to do so I understand that these costs will be charged to my credit card and all credit card charges are final. CRM will notify guest by email or phone when charging credit card for damages or other charges as applicable under the terms of this agreement.
